Santiago has more than 25 years of experience in commercial and family law disputes, and has played a key role in some of the most important commercial and financial disputes in the last decade. He has led multidisciplinary teams and participated in complex negotiations, achieving favorable results for his clients.
On the commercial side, Santiago has played a key role in some of the most renowned financial disputes in the country and has successfully resolved corporate conflicts within family-owned companies and even in some of those listed on the Mexican Stock Exchange.
Santiago also has a strong practice advising clients in complex commercial arbitrations, both domestic and international. He has excelled in disputes where arbitration converges with court proceedings.
In family matters, Santiago has handled some of the largest estate, probate and divorce disputes in Mexico, many with international components. Due to his experience in both types of disputes, Santiago has become a trusted advisor to many family law firms and high-level estate planning professionals. Santiago has even been invited as a panelist at various conferences related to the above.
Experience
Among the most relevant matters in which Santiago has participated are the following:
- Represents the shareholders and the board of directors of the second largest Mexican-owned bank in a claim for damages estimated at 3.5 billion pesos.
- Represented two shareholders of the main agave producer in Mexico and one of the most important tequila companies in the country in a corporate conflict over the corporate and economic control of the company.
- Represented an investment fund in two commercial proceedings arising from a financing granted to a casino licensee. The dispute eventually moved to an insolvency proceeding.
- Advised the seller in a claim for damages arising from the breach of a real estate purchase contract.
- Represented the leading franchisee and restaurant operator in Mexico in a dispute related to the purchase and sale of the largest Italian restaurant chain in the country.
- Successfully advised his client in a fiduciary rights dispute in the estate defense of a $100 million dollar real estate property in Los Cabos, Mexico.
- Represented a minority shareholder of the second largest flour producing company in the country in the defense of its economic and corporate rights, obtaining the liquidation of its shareholding.
- Represented a German company in a dispute between shareholders over the control of a leasing company in Mexico.
- Advised a hotel group in the dissolution of the company that managed an entertainment hotel in Cancun, Mexico.
- Advised a multinational oil and gas company in litigation arising out of an EPC contract as lead counsel in the Mexican court proceeding, and as co-counsel in an ICC international arbitration based in Mexico City.
- Represented, as co-counsel Mexican, the leading Mexican online gaming company in a multi-jurisdictional litigation involving court proceedings in Mexico and the United Kingdom, as well as an ICC arbitration based in London.
- Represented certain Mexican shareholders of a leading logistics company in a dispute related to the company's corporate governance. Acted as lead counsel in the legal proceedings in Mexico and as lead counsel in the Mexican co-counsel in an ICDR arbitration based in San Diego, California. GIA
